NCAL Releases Assisted Living State Regulatory Review 2011

The National Center for Assisted Living (NCAL) today released its Assisted Living State Regulatory Review 2011, which is at www.ncal.org. Published each March, this report summarizes state assisted living regulations in 21 categories. The 236-page report offers an easy-to-read summary of assisted living regulations in the 50 states and District of Columbia.

Six states—Idaho, Kentucky, Oregon, Pennsylvania, South Carolina, and Texas—made major changes. Of note, New Jersey and Washington made changes to policies regarding residents who received Medicaid services. Washington clarified its rule that boarding homes must fully inform residents about the home’s policy on accepting Medicaid as a payment source. New Jersey recently passed a law requiring an assisted living provider that surrenders its license, and had made promises not to discharge residents receiving Medicaid benefits, to set aside funds to pay for their care in an alternative setting. Eighteen states reported making statutory, regulatory, or policy changes affecting assisted living/residential care communities or assisted living Medicaid coverage.

Assisted Living State Regulatory Review is produced annually by NCAL and is widely utilized by state policymakers and regulatory agencies. NCAL makes this valuable resource available to its members and the public free of charge.
