Clarification Regarding Family Supplementation Change
By Toby Pearson

We have a correction/clarification to an answer that was provided during the legislative update webinar regarding family supplementation. We received clarification from the Department of Human Services regarding the limit on family supplementation of services stating:

The authority in law created last session governs supplementation of the service components bundled as customized living. It does not include supplementation of rent to occupy a housing unit, or food costs. Those are the responsibility of the person and may, depending on the payor source and its requirements, be supplemented by a family member. A housing provider is able to charge rent as established in the leases for tenants. The provider has to clearly distinguish rent from services across their tenant population as a whole.

Please note that all legal requirements concerning payor source on the rental agreements must be followed. There cannot be patterns of discrimination in rental pricing for EW versus non-EW tenants to make up for the difference between EW service payments and services or base rates charged to private-pay individuals.

The complete guide to the changes to Minnesota law after the legislative session is available in the advocacy section of our website here (click on 2011 Legislative Update Book).
