Emergency MA Payment Changes
By Toby Pearson This is a reminder that, effective January 1, 2012, there will no longer be payment for nonimmigrants currently on Emergency Medical Assistance (MA). The Legislature limited the services that are necessary for the treatment of an emergency medical condition for nonimmigrants who otherwise meet the Medical Assistance eligibility requirements. This legislation did not alter the eligibility requirements for Emergency MA, just the paid services. Section (h)(2) specifically lists the services that are not included in the treatment of an emergency medical condition, these include “continuing care, including long-term care, nursing facility services, home health care, adult day care, day training, or supportive living services.” Read more about this in our legislative update book here (scroll down to the last item under Miscellaneous). If you have nonimmigrants in your facilities who are currently enrolled in Emergency MA, effective January 1, 2012, that program will no longer cover continuing care, including long-term care, nursing facility services, home health care, adult day care, day training, or supportive living services. We continue to work with the Department of Human Services (DHS) for further guidance on how to make the transitions for these individuals as seamless as possible.
